Terms and conditions

These terms and conditions regulate the Agreement between "you" the customer and Bluebells home LTD (hereinafter referred to as " Bluebellshome.com")

By placing an order with Bluebellshome.com you are offering to purchase the goods detailed within that order, which Bluebellshome.com may or may not accept at their sole discretion.

If an order is accepted, Bluebellshome.com will send you an e-mail to confirm.

You undertake that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information, supplied by you during or after the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed, Bluebellshome.com will have right to rescind and upon their election to do so, the order will be cancelled.

If there are any changes to the details supplied by you, it is your responsibility to inform Bluebellshome.com as soon as possible.

Your statutory rights are not affected by these terms and conditions.

 

Liability

We attempt to ensure that the information available on the web site at any one time is accurate. However, Bluebellshome.com assume no duty to update such information and cannot guarantee that it will be fault-free.

Bluebellshome.com does not accept liability (except as set out below) for any errors and omissions in the presentation of goods on the web site and reserves the right to change information, specifications and descriptions of listed goods and products at any time. Bluebellshome.com will, however, do its best to correct any errors and omissions as quickly as practicable after being notified of them.

Bluebellshome.com does not make any warranty that the web site is free from infection by viruses or anything else that has contaminating or destructive properties.

Bluebellshome.com will only be liable for loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product purchased in respect of any claim.

You are required to print a Copy of Your receipt on which will appear your rights of cancellation in accordance with the Consumer Protection (Contracts Concluded by Distance Communication) Regulations 2000 which you agree to.

The liability section applies only to the extent permitted by law and does not affect your statutory rights.

The copyright, design rights and artwork on the web site belong to Bluebellshome.com. All other intellectual property rights are reserved. This website is for personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information obtained from this website. You may only download to your personal computer for viewing purposes and print out a number of pages of this web site for your personal use.

Unfortunately, because of the nature of selling via the Internet and product variability, we cannot guarantee that the product colours will be of an exact likeness as seen or as described. Although we strive to portray images in a realistic light, sometimes we are governed by what imagery is available. Product imagery is sometimes displayed in an aesthetic manner (mood shots may be used) and may not necessarily be in conformance with the approved use of such products.

The colours and dimensions of the products portrayed on the site are merely there as a guide. We strive to portray the products as near as we can to the actual colour ways, but we have no control over your personal computer and its settings. Some products incorporate natural materials (e.g. wood, leather, etc.) which may also vary slightly. 1 Cancellation

Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you have the legal right to cancel your order up to 14 calendar days after the day on which you receive your goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

2 Should you wish to cancel your order, please contact us using the contact page Email referencing “Cancellation”

3 If you have received the goods before you cancel your contract then you must send the goods back to our returns address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at our returns address at your own cost and risk as soon as possible.

4 Once you have notified us that you are cancelling your contract, and we have either received the goods back or, if earlier, received evidence that you have sent the goods back, we will refund any sum debited by us from your credit or debit card within 14 calendar days.

5 We may make a deduction from your refund for any loss in the value of the goods supplied if the loss is the result of unnecessary handling by you (for example using the goods prior to cancellation).

6 We reserve the right not to process your order if:

6.1 We have insufficient stock to deliver the goods you have ordered.

6.2 We do not deliver to your area; or

6.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

7 If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.

 

8 Delivery

8.1 Our delivery charges are set out on our website.

8.2 It may not be possible for us to deliver to some locations.

8.3 We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed and therefore time is not of the essence. In any event, we will aim to deliver your goods within 30 days from the day after the day we received your order. If delivery is delayed beyond this time, we will contact you and either agree a mutually acceptable alternative date, or offer you a full refund.

8.4 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

 

9 Risk and ownership

Risk of damage to or loss of the goods passes to you at the time of delivery to you. If you choose to use your own courier then the risk passes to you as soon as the goods are handed to your courier. You will only own the goods once they have been successfully delivered

 

Complaint and returns

10 If you have any questions or complaints about the goods please contact us.

10.1 We are under a legal duty to supply goods that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).

10.2 If you wish to exercise your legal rights to reject goods which do not conform with the Act you must inform bluebellshome.com as soon as possible using the contact page, stating reasons for return. We will direct you to either post them back to us, or arrange appropriate courier to collect, all items returned should be the original packaging and un-used.
